Mortgage Bankers

A mortgage banker is a lender that can originate loans which they can sell to Fannie Mae, Freddie Mac, Ginnie Mae, jumbo loan investors, and others. Thus a company who is capable of doing the above function is termed as a mortgage banker; however their size differs based on the different companies. Some mortgage bankers service the loans to the customers which they have originated while others do not. Most of the brokers have wholesale lending divisions. Some of the examples of mortgage bankers are Countrywide Home loans and Wells Fargo Mortgage. In this example one company is associated with a bank while the other is not. Many companies call themselves as mortgage bankers while some are really bankers but as far as the case of the others is considered it is mostly marketing.

Mortgage Brokers

Mortgage brokers are institutions who originate loans with the intention that they would give the amount to wholesale lending institutions. A broker has contacts or a set relationship with these wholesale lending institutions. Underwriting and the activity of funding takes place at the wholesale lender. They deal with the institutions that have wholesale loan department.

Wholesale Lenders

Many of the mortgage brokers and even the portfolio lenders act as wholesale lenders. They cater to the need of mortgage brokers for the origination of loan. There are some wholesale lenders that do not even possess their retail branches as they rely on mortgage brokers for the loans.

Portfolio lenders

An institution which lends own money and originates loans for itself is referred to as portfolio lender. Thus in this way they are lending their own portfolio of loans and they are not concerned about being able to sell them on the secondary market. Thus they need not abide by the rules of Fannie/Freddie guidelines and thus they can create their own rules for ascertaining the credit worthiness. Usually portfolio lenders are large banks. Only a particular part of their loan programs are portfolio products. Incase they are providing fixed rate of loans or government loans, and then they are definitely engaging in mortgage banking as well as portfolio lending.

Financial Advisors need to take their women client even more seriously

Financial Advisors need to take their women client even more seriously

The society being a patriarchal or male dominating one, the women involvement in most of the matters especially finances is never considered to be significant enough. Instances are there when a couple approaches a financial advisor, the male partner seems to be enjoying all the attention and leading the discussion rather the female partner.

This precisely the reason a woman rarely is heard of trusting an advisor when it comes to planning the finances. The Attitude of an adviser

Most of the financial advisers do not even consider taking the opinion of a woman in the family even if he is approached by both the couples. According to him, she is still the same women who had little knowledge about the finance related issues.

The advisers still live in the old age era when women had no decision making power on financial issues.

They rarely encourage a woman client to express her opinion. They never seek for their availability to explain the financial planning of the entire family. When they present a plan to the client they don’t feel the necessity of including the woman of the family. Advisers find explaining two people about the same plan as wastage of time, giving preference to the male partner.

Even when they meet both the couples, the preference is always given to the opinion of the husband than the wife. As because she is silent on many occasions, it is taken for granted that she does not have much understanding of the issue.

The changing scenario

With more and more number of women obtaining higher degrees and getting involved with a professional life, they have an equal hold on the issues related to finances. She know well how much she earns, or the family earns, what are the expenditures and how much saving is needed for the future requirements. There are many who work in the Finance Departments and handle the affairs brilliantly. Today’s women whether she has a major in Mathematics or economics or not, has a fair knowledge of financial development happening in and around. She is completely aware of various Insurance Plans, the benefits, the premiums and the taxes which she or her family is supposed to pay.

The Dangers of Insider Trading

The Dangers of Insider Trading

An insider is one who has information about a company and makes a trade based on privileged information. This undermines the faith people have in the market and harms investors who do not have access to the same information.

Information is the value of the stock and it is illegal to trade if you have non-public information affecting a stock’s price or value. Insider trading penalizes the general trading public who speculate on trending company information without actual knowledge. For example if you, as an officer of the company, knew that a new product would revolutionize the industry and drive your company’s stock prices up, and you bought up as many shares as you could before the public offering, you would be guilty of insider trading.

Illegal actions come into play when buying or selling a security while in the possession of non-public information or material about the stock or security. This includes trading by those who have a relationship of trust. The SEC has prosecuted insider trading cases against corporate officers, employees and directors who traded the company’ securities after they learned about significant developments. Friends and business associates of these officers and directors have had lawsuits brought against them for information given by those in a position of trust. If you are an employee of a law, banking or brokerage firm who was given company information and you traded on that information, you have just broken the law.

Insider trading destabilizes investor assurance in the integrity and fairness of the securities markets. Agents for the SEC consider discovery and prosecution of insider trading abuses as part of their high enforcement priorities. Investors must be highly conscious of the hazards in trading on tips from employees or officers who know private information about a company. If you are considering trading on inside information, know that this act carries severe civil and criminal penalties. Prison time is an option and fines that might just bankrupt you can be levied.

Insider trading can also be legal. It is legal when corporate officers, directors, shareholders or employees buy and sell stock within their own companies. They do report their trades to the SEC and this information is used to identify companies with high investment potential. The premise: if insiders are buying stock in their own company they must know their company is growing upwards.

You can trade in good confidence using insider tips or information if you can provide proof that the information you received had no bearing on your decision to trade and your trade was made in good faith. However, do be aware that the burden of proof is on your shoulders and could be very difficult to verify. Keep good records of every conversation you have with brokers. Document tips and where they came from and when you received them.

If a regulatory officer contacts your concerning your trades, hire a securities lawyer before you ever speak to regulators. Gather all your records and be ready to justify your insider trades.

Sec Employee Personal Trading Compliance Requirements

Sec Employee Personal Trading Compliance Requirements

One of the main issues impacting compliance officers today is the difficulty of monitoring the personal trading activities of employees in accordance with best practice and industry regulations. Adherence to rules such as SEC Rule 17j-1 and Rule 204A-1 and adoption of the best practices recommended by the SEC can be very time consuming and distracting for any compliance department.
The main requirements of an Investment Adviser under rule 204A-1 and Rule 17j-1 are:
Adoption of Code of Ethics.
Process to monitor employee personal trading
Reporting by all access persons of all holdings within ten days of becoming an access person and at least once within each twelve month period thereafter.
Submission of transaction reports by access persons no later than 30 days after the end of each calendar quarter. The report must cover, at a minimum, all personal trading transactions during the quarter.
Trade Pre-Clearance approval of certain investments. Access persons must obtain approval before they directly or indirectly acquire beneficial ownership in any security in an initial public offering or in a limited offering.

The SEC when amending rule 17j-1 in 2004 also recommended that Investment Advisers adopt the following in their code of ethics.
Prior written approval before access persons can place a personal securities transaction (“pre-clearance”).
Maintenance of Restricted lists e.g. Lists of issuers of securities that the Registered Investment Adviser firm is analyzing or recommending for client transactions, and prohibitions on personal trading in securities of those issuers.
Maintenance of “restricted lists” of issuers about which the Registered Investment Adviser has insider information, and prohibitions on any trading (personal or for clients) in securities of those issuers.
Blackout periods when client securities trades are being placed or recommendations are being made and when access persons are not permitted to place personal securities transactions.
Reminders that investment opportunities must be offered first to clients before the Registered Investment adviser or its employees may act on them, and procedures to implement this principle.
Prohibitions or restrictions on short-swing trading and market timing.
Requirements for employees placing personal trades to trade only through certain brokers, or limitations on the number of brokerage accounts permitted.
Requirements to provide the adviser with duplicate trade confirmations and account statements.
Procedures for assigning new securities analyses to employees whose personal holdings do not present apparent conflicts of interest.

There are many Personal Trading or Compliance Management systems which allow firms to automate this employee personal trading process. These systems vary from systems which capture employee brokerage statements to systems which allow you to provide end to end employee personal trading surveillance.

Commodities Trading Market With Financial Spread Betting

Commodities Trading Market With Financial Spread Betting

Commodities trading continues to be another popular avenue that traders have been pursuing. This pertains to trading in base metals, foods, gold and silver and so on. The trading is done in the same way to stocks and foreign exchange and the basis for trading may be the demand supply fluctuations in specific commodities.

So how does financial spread betting enter into play with commodities?

The answer is easy. The high costs of certain gold and silver for instance like gold, platinum would make it hard for that common trader to purchase and stock them for trading. If they are finding stock prices expensive, it’s possible to imagine how difficult it might be to trade commodities within the physical market. Moreover, these are not items which lend perfectly to physical trading unless you are in the company of commodities and also have your own wholesale or retail setup. That can be one reason for you to hedge positions by playing futures or spread betting in it.

For many traders however, commodity trading represents an opportunity to make quick money based on fluctuations within the international market and it is the same advantage of leveraged trading that they can enjoy when you are performing financial spread betting in it. Actually the whole of this year has seen tremendous upsurge in gold, silver and platinum prices and all sorts of those who have gone long on these gold and silver have made a lot of money.

The volatility inside a metal like gold is also not so high in the sense that prices might not have a huge dip. This encourages traders to maintain wide stop losses so that whether or not the price does drop, they aren’t stopped out and can trade the upswing again when they do their margined trading on this metal. Oil was another commodity that was heavily traded in the futures plus the financial spread betting market towards late 2008 which pushed in the oil prices significantly.

It must be however mentioned that prices of commodities do follow events in the international space also it would help if you can follow those closely. Additionally, local regulations also play operator with a few governments increasing or decreasing duties on either import or export on certain commodities they perceive are in short supply or in excess. This would have an immediate effect on the market price and that’s something traders have to be cognizant of.
